By accessing, using, or creating an account on LoveQUIL ("the Platform", "our Service"), you ("User", "you") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy.

LoveQUIL is a digital memorial platform that provides tools and services for:
- Creating and managing digital memorial pages for deceased loved ones
- Publishing and sharing obituaries with AI-assisted writing tools
- Preserving memories through photos, videos, and written tributes
- Facilitating community support during times of grief
- Connecting families with memorial and funeral service resources
Our services are designed with dignity, respect, and sensitivity to the grieving process. We reserve the right to modify, suspend, or discontinue any aspect of our Service with appropriate notice.
User Accounts and Responsibilities
To access certain features of LoveQUIL, you must create an account. You are responsible for:
- Providing accurate, current, and complete information during registration
- Maintaining the confidentiality and security of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use of your account
- Keeping your contact information updated
Account Security

- Family and friend contact information (with consent)
Prohibited Content
The following content is strictly prohibited:
- False, misleading, or fraudulent information about any individual
- Content that violates copyright, privacy rights, or publicity rights
- Inappropriate, offensive, defamatory, or harassing material
- Commercial advertisements or promotional content
- Content that causes additional distress to grieving families
- Spam, malicious code, or security threats
- Content that violates any applicable laws or regulations
Content Ownership and Licensing
You retain all ownership rights to content you submit to LoveQUIL. However, by uploading content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, store, modify, and distribute your content solely for the purpose of providing our memorial services.
This license includes the right to make your memorial content publicly accessible as intended by the nature of memorial services, and to preserve content even if your account is terminated, subject to family requests and our data retention policies.
Family Authorization
By creating a memorial page, you represent that you have the legal right and proper family authorization to create such memorial and submit related content. We may require verification of your relationship to the deceased person.
AI and Automated Services
LoveQUIL offers AI-powered tools to assist in creating obituaries and organizing memorial content. Our AI services are designed to help families during difficult times, but they have limitations:
- AI-generated content should always be reviewed and approved by family members before publication
- We strive for accuracy and sensitivity, but AI tools may produce errors or inappropriate suggestions
- AI services are provided "as is" without warranties of accuracy or completeness
- You are responsible for the final content that appears in any memorial or obituary
Privacy and Data Handling
We collect and use personal information as described in our Privacy Policy, which is incorporated into these Terms by reference. Key privacy considerations include:
- Memorial content may be publicly viewable as intended by memorial services
- We implement industry-standard security measures to protect sensitive information
- We may share anonymized, aggregated data for research and improvement purposes
- We comply with applicable data protection laws including GDPR and CCPA
Data Retention
Memorial content is retained indefinitely to preserve legacies, unless specifically requested for removal by authorized family members. Personal account data follows our standard retention policies outlined in our Privacy Policy.
Third-Party Services
LoveQUIL integrates with trusted third-party services to provide enhanced functionality:
- Firebase (Google): User authentication, data storage, and analytics
- Mapbox: Location services and mapping features for memorial locations
- Additional services: Email delivery, image processing, and security services
These services operate under their own terms of service and privacy policies. We are not responsible for third-party service practices, availability, or security, though we select partners based on their reputation and privacy standards.
Prohibited Uses
You may not use LoveQUIL to:
- Violate any applicable local, state, national, or international laws or regulations
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Create false or fraudulent memorial pages
- Harvest, collect, or misuse personal information of other users
- Interfere with or compromise the security, functionality, or performance of our Platform
- Use automated tools, bots, or scripts to access our Service without explicit permission
- Engage in any commercial activities without our express written authorization
- Upload viruses, malware, or other malicious code
- Attempt to gain unauthorized access to other user accounts or our systems
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- FOREVER MEMORY INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- THIS INCLUDES BUT IS NOT LIMITED TO LOSS OF DATA, EMOTIONAL DISTRESS, LOST PROFITS, OR BUSINESS INTERRUPTION
- OUR LIABILITY APPLIES WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHER LEGAL THEORY
- THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
- OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED $100
Dispute Resolution
Governing Law
These Terms and any disputes arising from them are governed by the laws of the State of New Hampshire, without regard to conflict of law principles.
Arbitration
Any legal disputes arising from these Terms or your use of LoveQUIL will be resolved through binding arbitration conducted in New Hampshire under the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits against Forever Memory Inc.
